Heart Arch Events Terms & Conditions

By submitting a booking deposit, the Client acknowledges that they have read, understood, and agree to these Terms & Conditions.

1. Services & 2. Booking Deposit

1. Services

Heart Arch Events is a proposal planning and event coordination company. Our primary service is planning, coordinating, designing, and managing marriage proposal experiences. While we may provide décor and planning services directly, certain services including, but not limited to, photography, videography, musicians, florists, transportation, venues, catering, private chefs, and other specialty services may be fulfilled by independent third-party vendors. Heart Arch Events acts as the coordinator of these services but is not responsible for the independent actions, performance, delays, cancellations, or quality of services provided by third-party vendors.

2. Booking Deposit

A booking deposit is required to reserve your proposal date. All deposits are non-refundable. Your event date is not secured until the required deposit has been received. The remaining balance must be paid by the due date listed on your invoice or 7 days prior to your event day - whichever is earlier. Failure to make payment may result in cancellation of services.

If the Client cancels the proposal: More than 3 calendar days before the event, Heart Arch Events will allow one complimentary reschedule to another available date within 90 days of the original proposal date. Requests made within 3 days of the scheduled proposal are not eligible for refunds or complimentary rescheduling. Any additional reschedules beyond the first may be subject to a rescheduling fee. Deposits remain non-refundable under all circumstances.

4. Weather Policy

Outdoor proposals are subject to weather conditions. If Heart Arch Events determines that weather conditions create an unsafe environment, the proposal will be rescheduled or relocated. Inclement weather includes, but is not limited to:

  • Active weather advisories or warnings issued by the National Weather Service
  • Sustained winds or wind gusts exceeding 20 mph
  • Heavy rainfall or forecasted rainfall exceeding 0.25 inches during the scheduled event window
  • Lightning
  • Severe thunderstorms
  • Hail
  • Snow or ice creating unsafe conditions
  • Flooding
  • Any weather condition that may damage décor or create safety concerns

The decision to postpone or relocate due to weather rests solely with Heart Arch Events.

5. Outdoor Public Locations & 6. Venue & Permit Responsibility

5. Outdoor Public Locations

Many proposals take place in public outdoor spaces. Heart Arch Events cannot guarantee access to public parks, waterfronts, rooftops, overlooks, beaches, or other free public locations due to circumstances beyond our control, including but not limited to:

  • Park closures
  • Government restrictions
  • Construction
  • Unexpected events
  • Private events
  • Law enforcement requests
  • Crowds
  • Maintenance
  • Permit requirements

If the original location becomes unavailable, Heart Arch Events will relocate the proposal to another suitable outdoor location whenever possible. Location changes resulting from circumstances outside our control shall not constitute a breach of this agreement.

6. Venue & Permit Responsibility

Some locations require permits or venue approval. Unless specifically included in your proposal package, obtaining permits, venue approvals, parking fees, admission fees, or reservation costs remains the Client's responsibility. Heart Arch Events is not responsible for denied permits or venue restrictions imposed by third parties.

7. Third-Party Vendors & 8. Client Delays

Heart Arch Events carefully selects professional vendors; however, vendors operate as independent businesses. Heart Arch Events is not liable for:

  • Vendor illness
  • Equipment failure
  • Traffic delays
  • Late arrival
  • Cancellation
  • Service quality
  • Acts of negligence by independent vendors

If a vendor becomes unavailable, Heart Arch Events will make reasonable efforts to secure a comparable replacement.

8. Client Delays

Proposal timelines are carefully planned. If the Client arrives late:

  • Services may be shortened.
  • Certain elements may not be completed.
  • Vendors may leave at their scheduled end time.
  • Additional waiting time may incur additional fees.

No refunds will be provided due to client delays.

9. Surprise Proposal Timing & 10–11. Décor & Photography

Because proposal timing depends on maintaining the surprise, the Client agrees to follow the approved timeline and instructions provided by Heart Arch Events. Heart Arch Events is not responsible if the surprise is compromised due to actions taken by the Client or their guests.

10. Décor

Décor rentals remain the property of Heart Arch Events unless otherwise stated. The Client is responsible for any damage, theft, or excessive cleaning resulting from misuse by the Client or guests. Replacement costs may be charged for damaged or missing rental items.

11. Photography & Video

Heart Arch Events is not responsible for missed photographs or videos due to:

  • Client arriving outside the scheduled timeline
  • Equipment malfunction by independent photographers
  • Weather
  • Public interference
  • Venue restrictions
  • Unexpected circumstances beyond reasonable control

12. Force Majeure & 13. Limitation of Liability

Heart Arch Events shall not be liable for delays, cancellations, or inability to perform services resulting from events beyond reasonable control, including but not limited to:

  • Natural disasters
  • Severe weather
  • Government orders
  • Public emergencies
  • Terrorism
  • Civil unrest
  • Power outages
  • Venue closures
  • Transportation disruptions
  • Acts of God

Whenever possible, Heart Arch Events will work with the Client to reschedule the proposal.

13. Limitation of Liability

Heart Arch Events' total liability shall not exceed the amount paid by the Client for the services contracted. Heart Arch Events shall not be liable for indirect, incidental, consequential, emotional, or special damages arising from the event.

14. Client Responsibility & 15. Media Release

The Client is responsible for:

  • Providing accurate event information
  • Having possession of the engagement ring
  • Arriving on time
  • Following the event timeline
  • Informing Heart Arch Events of any changes as soon as possible

15. Media Release

Unless otherwise requested in writing, the Client grants Heart Arch Events permission to photograph and share event photos and videos for marketing purposes, including social media, advertising, website galleries, and promotional materials. Clients may opt out by notifying Heart Arch Events in writing before the event.

16–18. Right to Refuse, Creative Design & Proposal Outcome

Heart Arch Events reserves the right to refuse or terminate services if the Client or guests engage in unsafe, abusive, illegal, threatening, or inappropriate behavior.

17. Creative Design & Substitutions

Heart Arch Events reserves the right to make reasonable substitutions to décor, florals, rental items, props, candles, balloons, or other design elements due to product availability, weather conditions, vendor availability, or circumstances beyond our control. Any substitutions will be of equal or greater value and will maintain the overall aesthetic and experience of the original design.

18. Proposal Outcome

Heart Arch Events is responsible for planning, coordinating, and executing the proposal experience. We cannot guarantee the outcome of the proposal, including whether the proposal is accepted. No refunds or credits will be issued based on the outcome of the proposal.

Any requested changes to the proposal, décor, timeline, location, vendors, or event details must be submitted in writing. Requests made within 72 hours of the scheduled proposal date may not be accommodated and, if approved, may be subject to additional fees. Heart Arch Events reserves the right to decline changes that would negatively impact the quality, safety, or feasibility of the event.

20. Location Access

For proposals taking place in public or privately owned spaces, access is subject to the policies and decisions of the property owner, venue management, security personnel, or government authorities. If Heart Arch Events is instructed to relocate, modify, or remove the setup by venue staff, security, law enforcement, or other authorized personnel, we will comply immediately. Such actions shall not constitute a breach of this agreement, and refunds will not be issued for circumstances beyond our control.

21–23. Vendor Pricing, Client Property & Damage

21. Vendor Pricing

Quotes provided for third-party vendors are based on pricing available at the time of planning. Vendor pricing may change until services are confirmed and deposits have been paid. If vendor pricing increases before confirmation, the Client will be notified and given the option to approve the updated pricing or select an alternative service, where available.

22. Client Property

The Client is solely responsible for all personal belongings brought to the event, including but not limited to engagement rings, jewelry, gifts, personal electronics, vehicles, and other valuables. Heart Arch Events is not responsible for lost, stolen, misplaced, or damaged personal property before, during, or after the event.

23. Damage Caused by Client or Guests

The Client assumes responsibility for any damage caused by themselves or their guests to Heart Arch Events' décor, rental equipment, or property, as well as to the property of any third-party vendor or venue resulting from the Client's event. The Client agrees to reimburse Heart Arch Events for the cost of repair or replacement of any damaged or missing rental items.
